Terminology

eeMotion® is a Trademark and Trading Name of ExemPLM Ltd. ‘eeMotion’, ‘ExemPLM’, ‘We’, ‘Us’ may be used interchangeably and refer to ExemPLM Ltd. The operators of the eeMotion Retail Stores and Websites. ‘You’, ‘Your’ refer to the viewer, visitor or customer of the Store or Website. Official Company Details are listed on the ‘About Us‘ Page. For Warranty information, see the ‘Warranty Info‘ Page. The Terms and Conditions below are divided into 3 main segments. ‘Common’, ‘In Person’ and ‘Not In Person’. The ‘Common’ Terms and Conditions apply in all cases in addition to the Specific Terms and Conditions listed under the ‘In Person’ and ‘Not In Person’ sections later on this page.

Common Terms and Conditions

By accessing or using our Websites or Stores you agree to comply with and be bound by our terms, conditions and policies.

Use of and Access to our Websites and Stores and any disputes that might arise out of such are subject to the relevant laws of England, Scotland and Wales.

Our Terms and Conditions may be updated by us from time to time without notice. Hence, we would recommend you to make a copy of these terms as displayed at the time of purchase.

Content of Website and Literature

Content on our Websites and Literature are for General Information only and may be changed without notice. While we have attempted to ensure the information provided is accurate, it is provided as-is and for use at your own risk. Any references to products, services or external sites are for general Information only and should not be considered as endorsements. We bear no responsibility for embedded content or links from or to external sites. It is the responsibility of the purchaser to confirm that products and services obtained from us will be suitable for their particular requirements. Content on our Websites and Literature are subject to copyright. We acknowledge 3rd Party copyright and trademarks where used. Content from our Websites or Literature must not be used or reproduced without obtaining written authorisation for the specific use. Use must be limited as per the authorisation given with the understanding that any authorisation granted may be revoked at any time.

Sale of Goods and Returns

Goods are not sold on a trial basis unless explicitly stated. Unused goods may be returned for a refund within the timeframe prescribed in the specific terms and conditions section for the type of sale (‘In Person’ or ‘Not In Person’), subject to the following conditions:

  • The goods are normally stocked and sold by us. e.g. they were not obtained as a special request on behalf of the customer.
  • No additional work has been carried out on behalf of the customer. e.g.  modifications, upgrades, non standard assembly.
  • The goods are returned unused, as new. Including all packaging,  any accessories, promotional items and free gifts.
  • Labels, stickers, inserts etc. must not be removed or tampered with.
  • Where packaging needs to be opened to inspect the goods, it must be opened and with appropriate care, so as to ensure there is no damage to the content or unnecessary damage to the packaging itself (e.g. Tape should be carefully cut, not ripped off causing damage to the box etc.).
  • Goods sold are no longer refundable once used or altered in any way.

If returns don’t meet the above criteria, they may be rejected (with the customer required to collect or pay shipping charges) or a restocking fee applied.

  • Where a return is rejected, you will be sent notification accordingly. You agree that if you do not collect the goods or pay return shipping charges within 60 days of being sent notification:
    • That you no longer want the goods.
    • They can be treated as abandoned and consent to us taking ownership of the good without any recompense.
    • NOTE: We may at our discretion, as a gesture of good will offer a partial refund after taking account of the inconvenience and costs incurred along with any perceived remaining value of the goods.
 Goods Sold on a Trial Period Basis

For some products, we may offer a trial period. This must be explicitly stated in the product description. Where a trial period option is offered, the following additional terms and conditions apply.

  • Trial of the goods is NOT Free. It is subject to restrictions on the amount of use, type of use and a fee for the trial period as listed in the description or related links.
  • All items sent as part of the Product purchase (e.g. Charger, Accessories, Manuals, Packaging etc.) must also be returned with the device.
  • Additional items purchased along with the device are not part of the trial, but may be returned unused under our standard terms and conditions for returns.
  • Any separately listed Shipping fee charged at the time of ordering is not included as part of the trial and will not be taken into account when calculating the total amount to be refunded.
  • The Goods including packaging and accessories must all be returned in the same condition they were provided and usage limited a per the trial period restrictions. We allow for minor wear and tear of the device but not significant damage, be it functional or cosmetic.
  • For the above reason, we recommend also purchasing suitable padding to help protect your device while learning. The cost of the padding once used will not be included in any refund.
  • Any padding, adhesives, coverings, accessories etc. added to the device must be removed before returning it. Failure to do so may incur an additional labour charge for us to remove them.
  • You authorise us to attempt removal and disposal of any attachments to the device regardless of whether we agree to accept the unit back under the terms of the trial.
  • You must provide on request suitable photo and video footage of the unit to help us assess the condition of the device prior to returning it. This is so we can minimise the likelihood of disputes regarding the condition of the device.
  • Goods returned to the store in person will need to be left for later inspection by a qualified technician.
  • Where Goods are returned after inspection be found not to meet the trial terms, we may at our discretion :
    • Make an offer to accept the return after deduction of additional fees, taking account of use beyond the trial restrictions, expected parts and labour cost of repairing/restoring the unit irrespective of whether we choose to do so.
    • Reject the return and require you to collect the unit or arrange shipment back to you at your cost.
  • Where a return is rejected, you will be sent notification accordingly. You agree that if you do not collect the goods or pay return shipping charges within 60 days of being sent notification :

 ‘In Person’ Terms and Conditions (At the Store, Face to Face etc.)

The following terms and conditions are in addition to the common terms and conditions listed above.

  • For ‘In Person’ sales, the timeframe for the return of goods under the common terms and conditions is 14 days. Where the store has been closed for an extended period, the returns period will also be extended by the equivalent number of working days.

‘Not In Person’ Terms and Conditions (Website/Online Store/Phone etc.)

The following terms and conditions are in addition to the common terms and conditions listed above.

  • For ‘Not In Person’ sales, you must inform us that you wish to return the goods within 14 days of receipt and the goods must be returned within 14 days of being sent an authorisation to return the goods.
  • You are responsible for :
    • Returning the goods, including all costs associated with returning them.
    • Taking care of the goods and ensuring they reach us undamaged.
    • Any damage that occurs whilst in your care or whilst being returned to us will be your responsibility. Goods should be suitably insured against loss or damage whilst under your care.

Statutory Rights

The statutory rights of a consumer are not affected and are given legal precedence over our Terms and Conditions, should a conflict be proven between them. You can find out more information about your rights as a consumer by searching online for ‘UK statutory consumer rights’
